Ahh, what a beaut.
“Destroying government records, as the Reformatories propose to do with the gun registry data, is against the law.
The Library and Archives of Canada Act demands that the disposal of records managed by government institutions “must occur under processes and procedures which permit the identification and preservation of archival and historical records.”
To be specific, per section 12. 1 of the Act, “no government or ministerial record, whether or not it is surplus property of a government institution, shall be disposed of, including by being destroyed, without the written consent of the Librarian and Archivist or of a person to whom the Librarian and Archivist has, in writing, delegated the power to give such consents.”
So, unless the top Librarian and Archivist has given the okay in advance, which I rather doubt, the Cons have announced that they plan to break their own law…”
I think the idea here is that they are changing the law. Majority governments can do that. Your mentor knew all about that.
But what’s more is this: let’s deal with the millions of taxpayer’s dollars that went missing to Liberal friendly-ad firms in Quebec (yes, that doozy that hasn’t gone anywhere) before we go on about a gun registry that just keeps its thumb on law abiding citizens.
It just keeps getting better and better.
The registry is useless. Kill it.

Kinsella omits the ‘exception’ to 12 (1),
he just had to read 2 paragraphs further……
(which explains why he didn’t link to the site)
Library and Archives Act
Exception to 12(1)
12(3) For the purposes of this section, the Librarian and Archivist may have access to a record to which subsection 69(1) of the Access to Information Act applies, only with the consent of the Clerk of the Privy Council and to a government record that contains information the disclosure of which is restricted by or pursuant to any provision set out in Schedule II to that Act, only with the consent of the head of the government institution in question.

Our little friend isn’t very good with that “law talking stuff”. (Unless he’s trying to sue someone)
Further, the Govt has to send the info to the Library, there is no automatic entitlement…
Privacy Act
6 (3) A government institution shall dispose of personal information under the control of the institution in accordance with the regulations and in accordance with any directives or guidelines issued by the designated MINISTER in relation to the disposal of that information.
37 (3) Subject to any other Act of Parliament, personal information under the custody or control of the Library and Archives of Canada that has been TRANSFERRED THERE by a government institution for historical or archival purposes may be disclosed in accordance with the regulations to any person or body for research or statistical purposes.
‘….for research or statistical purposes’
get that Warren?
PM has and had used ‘getting rid of the gun registery’ during his campaign and look where he is in government with a majority. Meanwhile, the opposition mps whose constituents who favoured getting rid of the gun registery were not re-elected.
The liberals are eyeing the $2billion going down in flames in front of them. they want that 2billion dollars so bad it aches.
We have gone through numerous of killings by some crazed person… did the ‘so call’ gun registery managed to save the people lives before being killed?
Guns are already registered, I couldn’t possibly walk into a gun shop and simply buy a gun just like that. I have to acquire a police report first, then attend firearm classes and few other things before acquiring a gun.
dosen’t warren Kinsella know that the federal government makes the laws so they can do what ever they want. and if he has a problem with it then he should run for the liberal party and change the rules.
Who cares what he thinks? He’s a washed up, has-been Dino Chretien era weasel. He hasn’t been anywhere near the halls of power for years now.
You might as well be concerned about what some unemployed, drunken, elderly panhandling bum thinks of the registry for all the influence Kinsella has.
The government is getting rid of the registry. If he doesn’t like it – tough. There’s not a damned thing he can do about it.
Poor Warren…
Go to his site and read the comments on this, they are pretty funny.
He actually got his ass handed to him by his own regular posters, who wondered why, after someone posted the other section mentioned above, he tried to claim that it was “a COMM strategy, not a legal one”. They pointed out, as gently as possible, that he had in fact used the words “Illegal” and “breaking the law”, so how was this not a legal issue? After trying to weasel out of it a couple more times, Warren finally said “I give up” (implying, of course, that everyone else was just too dumb to understand his reasoning). It was hilarious!
You really need to read his blog (oops…his “website”, as he insists on calling it) regularly to get the full picture on what a shameless liar he really is. Twice before I’ve seen people call him on his BS, to which he responds “Prove it.”. So they do, by posting the real facts. Warren’s counter-response? NOTHING. He knew his claims wouldn’t stand up to even the most cursory scrutiny, but that wasn’t the point: the point was to utilize the Big Lie technique to get the information out there enough times that people would begin to accept it. It doesn’t need to be true…it just needs to be seen.
Sadly, poor Warren hasn’t yet figured out that those old tried-and-true tactics from his glory days in the Liberal War Room no longer work in this age of internet search engines, smart phones and instant communications. He posted another jaw-dropper just the other day, when he stated his desire to see Jean Chretien come out of retirement and “mop the floor” with Stephen Harper (or “kick his ass”, or some such nonsense). When people pointed out the extreme unlikelihood of that outcome even if Chretien were to be dumb enough to try, Kinsella didn’t take kindly to it. He evens talks about running for office again himself, believe it or not…
Kinsella, you’re a lawyer. Go practice law.
I’m certain there are a few ambulance chasing practices in the scummier parts of town that would be willing to hire you. You know, on the condition that you keep your mouth shut and stay in the background of course.
It just keeps getting better and better.
Exactly TT, it does get better for us that is not for the liberals.
‘The Untold stories’ of liberals not spoken utter nor mentioned by CBC is becoming Real. The poor souls who have been brainwashed by CBC and even CTV is slowly becoming a reality. ” where have I been all those years not to know that I have been duped. How can I be so stupid to fall for CBC’s and liberals’ every word?”
O/T, TT, the NDP are worse they want canada to be in a standstill no dealing with anyone outside this country; they want your money to redistribute it to people of their own choosing while retaining/keeping their ‘high price salary to themselves. Poverty, poor, homelessness etc is all a sing song to them.Their involvement with the union is stronger than for the ordinary folks. I notice that the media including the SNN rarely speak of NDPQ or liberals. Apparently it is only us the bloggers, who are doing the most of job for/in place of the media.
Will the small libs join the NDPQ… most likely.
Oh, wow…
Check our Warren’s blog again. Today he’s getting his ass kicked over reposting a Toronto Star story showing a picture of a .50 caliber sniper rifle and labelling it a Mini-14 (“the same gun used in the Ecole Polytechnique massacre”). He refused to admit that he was wrong until enough people had pointed out the same thing to him, at which time he started accusing “neo-Nazis” of linking to him and sending all these new posters his way.
(seriously…that’s what he said.)
But the best part? The original picture and original lie about the type of firearm actually pictured (since removed by the Star) is STILL THERE on LibLogs, linking to Warren’s page… Love it!:)
